You must be at least 13 years old (or the minimum age of digital consent in your jurisdiction) to use the Service. You are responsible for the activity that happens under your account and for keeping your login credentials secure. Provide accurate information and keep it up to date.

PocketChallenger is a digital-to-physical training companion for pool and billiards players. It delivers structural "challenge blueprints" and courses for you to set up and practice on a real table. It is not a simulator and does not guarantee any particular outcome or improvement in your skill. Content is provided for informational and training purposes only.

You may submit content such as challenges, answers, and courses ("User Content"). You are solely responsible for your User Content and represent that you have the rights to share it. You agree not to post unlawful, infringing, harmful, or abusive content, not to misuse or attempt to disrupt the Service, and not to scrape, reverse-engineer, or access the Service in an unauthorized way.

You retain ownership of your User Content. By submitting it, you grant us a worldwide, non-exclusive, royalty-free license to host, store, reproduce, display, and distribute it for the purpose of operating, promoting, and improving the Service. We may remove content that violates these Terms.

Some courses are sold for a one-time price in U.S. dollars. Payments are processed by Stripe; we do not store your full card details. Once a purchase is completed, access to the course is tied to your account and is permanent, except where access is revoked for a violation of these Terms. Free courses remain open to all signed-in users.

Course creators are independent sellers. We facilitate the transaction and provide the platform, but the creator is responsible for the content of their course.

Because courses provide immediate access to digital content, all sales are final. At our discretion, we may issue a refund on a case-by-case basis — for example, for a duplicate or clearly erroneous charge. To request a discretionary refund, contact support@pocketchallenger.com. Refunds, when granted, are processed through Stripe. Nothing here limits rights you may have under applicable law.

If you sell courses, additional terms apply. See the Creator Agreement, which is incorporated into these Terms for sellers.

The Service, including its software, design, branding ("PocketChallenger"), and content we provide, is owned by Profound AI Solutions LLC or its licensors and is protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable license to use the Service for its intended purpose.

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including fitness for a particular purpose and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that training content will improve your performance. Practicing on a physical table is at your own risk; you are responsible for your own safety and equipment.

To the maximum extent permitted by law, Profound AI Solutions LLC and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill, arising out of your use of the Service. Our total liability for any claim relating to the Service will not exceed the greater of the amount you paid us in the twelve months before the claim or USD $100.

You agree to indemnify and hold harmless Profound AI Solutions LLC from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of your User Content, your use of the Service, or your violation of these Terms.

You may stop using the Service at any time. We may suspend or terminate your access if you violate these Terms or to protect the Service or other users. Purchases you have already completed remain governed by these Terms.

We may update these Terms from time to time. When we do, we will revise the "Last updated" date above. Material changes may be communicated through the Service. Continued use after changes take effect constitutes acceptance.

These Terms are governed by the laws of the State of California, USA, without regard to its conflict-of-laws rules. You agree to the exclusive jurisdiction of the state and federal courts located in California for any dispute that is not subject to arbitration or small-claims court.
